Council Tree Permits in Sydney

Many Sydney councils protect trees on private land, and removing a protected tree without approval can lead to heavy fines. We check the rules for your address and help you with the application.

How it works

Do you need council approval to remove a tree?

Often, yes. In NSW, councils control tree removal and pruning on private land through their Development Control Plans (DCPs), made under the State Environmental Planning Policy (Biodiversity and Conservation) 2021. Each council sets its own rules about which trees are protected, so a tree that can be removed freely in one suburb may need a permit in the next.

If the tree is part of building work, its removal is normally dealt with in your development approval. Outside development, you apply to the council for a tree permit. Where a property is bushfire prone, the NSW 10/50 vegetation clearing rules may also apply.

Not sure? Call 0452 121 300. We check the council rules for your address as part of every free quote and tell you plainly whether a permit is needed.

FAQ

Council tree permits: common questions

Which trees need a permit?

Each council decides which trees are protected, usually by trunk size, height, species and where the tree is on the block. Some councils also protect particular species or trees in heritage or bushland areas. Because the rules differ, we check them for your address before we quote.

What about dead or dangerous trees?

Many councils have a faster process, or an exemption, for trees that are dead or an immediate danger, but you usually still need to notify the council or get written confirmation. Don't assume. Ask us or your council first.

What is the 10/50 rule?

In NSW, if your property is in a designated 10/50 vegetation clearing entitlement area, you may be able to clear trees within 10 metres of your home without council approval. Check your address with the NSW Rural Fire Service's online tool before relying on it.

Can you help with the application?

Yes. Helping clients with council tree applications is part of our service. We can tell you what the council is likely to ask for and what information to include.
